What is a Settlement Agreement?

A settlement agreement is used as a mechanism to terminate your employment. Once signed, it is a legally binding contract between you and your employer. The essence of the agreement is that you sign away your rights to pursue claims in exchange for a sum of money. In some circumstances, it avoids the need to pursue legal proceedings and gives you the comfort and certainty of a guaranteed sum of money. The benefit to your employer is that they know you will not be pursuing a claim against them in the future. If your employer has provided you with a Settlement Agreement, it is a legal requirement that you take independent legal advice from a qualified solicitor and you will receive a contribution to your legal fees in order to assist with this.

When is a settlement agreement used?

They can be used in a variety of situations. For example, you may be involved in a redundancy consultation and as an alternative to finishing this process, your employer may offer you an enhanced redundancy payment if you sign a settlement agreement. You may be involved in a dispute which is heading towards legal proceedings. A settlement agreement can be used to settle the dispute and avoid lengthy and expensive legal proceedings. Alternatively, there may be no dispute at all but your employer wants the comfort and certainty of agreeing the terms of your exit within a settlement agreement.
