Pre-nuptial and Post-nuptial Agreements
A Pre-Nuptial Agreement is entered into before a couple marries or enter a civil partnership. Such an agreement is intended to minimise the complex issues which can arise should a couple separate, by setting out how assets should be shared.
A Post-Nuptial Agreement is intended to set out the same terms but is entered into after a party’s marriage or civil partnership.
Before entering into any agreement it is important that each party fully discloses their financial positions and takes independent legal advice. The agreement terms must also be fair and provide for future changes in circumstances, such as the couple having a family.
