Employment Tribunal Ruling: The “Good Citizen Award” Dispute

In July 2023, Citizens Advice Manchester introduced a “Good Citizen Award” to recognise staff for outstanding collaboration, with the winners receiving an extra day of leave on their birthday. The announcement was made on the company’s internal forum, allowing employees to share feedback. The Claimant commented, “That sounds a bit dubious to me,” while another employee remarked, “We are all good citizens. Perhaps we should all get our birthday off.”

In response, the Chief Executive posted, “What’s dubious is whether those with negative attitudes align with the values and culture of Citizens Advice.” The Claimant later expressed to her manager that she felt undervalued because of the comment. In October 2023, she resigned without directly referencing the Chief Executive’s remark, but later filed a claim for constructive unfair dismissal, alleging a breach of the implied duty of mutual trust and confidence.

The Tribunal ruled against the Claimant, finding that the Chief Executive’s response was justified and not a threat to her job security. The claim was dismissed.
